• consumers browsing listings and using tools ("Consumers")
• dealers, manufacturers, advertisers, and other businesses listing or promoting products ("Trade Users")
• anyone who creates an account or submits content ("Users")

Some Services may have additional terms (for example, advertising terms or dealer onboarding terms). If those additional terms conflict with these Terms, the additional terms apply to that specific Service.

Changes to these Terms

We may update these Terms to reflect changes to the Services, our business, or legal requirements. We will update the effective date above. Your continued use of the Services after changes means you accept the updated Terms.

Access to the Services

We may change, suspend, or withdraw any part of the Services at any time. We do not guarantee the Services will always be available, uninterrupted, or error free.

You are responsible for ensuring your device, browser, and internet connection can access the Services.

Accounts

Some features require an account. You agree to:

• provide accurate and up to date information
• keep your login credentials secure
• notify us promptly if you suspect unauthorised access

You are responsible for activity that occurs under your account unless it is caused by our breach of these Terms.

Listings, dealer profiles, and trade content

Listing accuracy

Listings and profile content may be provided by dealers, manufacturers, third party feeds, or Users. We may also display helpful guidance, inferred values, or confidence labels where information is missing or inconsistent.

We do not guarantee that listing information is complete, accurate, or up to date. You should verify key details directly with the dealer or manufacturer before making decisions.

Dealer profile claims and verification

Trade Users may be able to claim a dealer profile. We may request verification evidence. We may approve or reject claims at our discretion and may remove access if we believe a claim is invalid, misleading, or unauthorised.

Responsibilities for Trade Users

If you submit or control listings, stock feeds, images, pricing, specifications, or promotional claims, you are responsible for:

• accuracy and legality of that content
• having all rights needed to use any images, trademarks, or text
• compliance with applicable advertising, consumer protection, and data protection laws

Tools and guidance are informational only

Our tools and guides (including towing calculators, licence guidance, layout tools, and comparisons) are provided for general information only. They are not legal, mechanical, safety, or professional advice.

You must check manufacturer specifications, your vehicle handbook, and applicable laws and guidance. If you need expert advice, speak to a qualified professional.

Acceptable use

You must not:

• use the Services for unlawful purposes
• interfere with, damage, or disrupt the Services
• attempt to gain unauthorised access to systems, accounts, or data
• upload or transmit malware or harmful code
• spam users, dealers, or our enquiry systems
• impersonate others or misrepresent your affiliation

We may suspend or terminate access if we reasonably believe you have violated these Terms.

Ownership and intellectual property

Our intellectual property

The Services and all associated rights are owned by RoamWorthy or our licensors, including:

• site design, layout, and interface elements
• software, code, algorithms, and systems
• databases, compilations, and structured datasets (including database rights)
• curated mappings and derived data (including model, layout, and compatibility data where applicable)
• text, graphics, logos, and brand assets

Limited licence to use the Services

We grant you a limited, non exclusive, non transferable, revocable licence to access and use the Services for personal use (Consumers) or internal business use (Trade Users) in accordance with these Terms.

You must not copy, reproduce, distribute, sell, licence, lease, modify, create derivative works from, or exploit any part of the Services unless permitted by law or with our prior written consent.

Scraping, automated access, and data harvesting

Automated access is prohibited unless we have expressly agreed in writing, for example via an API agreement. If you want permission for legitimate purposes (partners, feeds, research), contact [email protected].

We may implement technical measures to prevent scraping and may block suspicious traffic. Unauthorised scraping may result in legal action, including claims for breach of contract and infringement of database rights and copyright.

User content

"User Content" means anything you submit, such as reviews, messages, photos, and profile information.

Your responsibilities

You confirm you have the rights needed to submit User Content and that it does not infringe third party rights or break any laws.

Licence you grant to us

By submitting User Content, you grant us a worldwide, royalty free, non exclusive licence to host, store, reproduce, adapt, publish, and display that content to operate, promote, and improve the Services.

Third party services and links

The Services may include links or embedded tools from third parties (for example maps). We do not control third party services and are not responsible for them. Your use of third party services is governed by their terms.

Enquiries and transactions

RoamWorthy is not a party to any transaction between Consumers and Trade Users. We do not guarantee that enquiries will be answered or that any sale will occur. Any agreement you enter is between you and the relevant dealer or manufacturer.

Payments, promotions, and advertising

If you purchase advertising, promoted placement, or other paid Services, additional terms may apply. Fees are non refundable unless required by law or agreed by us in writing.

Disclaimer of warranties

To the fullest extent permitted by law, the Services are provided on an "as is" and "as available" basis. We make no warranties that the Services will be uninterrupted, secure, error free, or that content will be accurate or complete.

Nothing in these Terms limits consumer rights that cannot be excluded under applicable law.

Limitation of liability

To the fullest extent permitted by law, we will not be liable for indirect or consequential losses, including loss of profit, revenue, goodwill, opportunity, or data.

If we are found liable to you, our total liability for claims relating to the Services will be limited to the greater of:

• £100, or
• the fees you paid to us for the relevant paid Service in the 12 months before the claim arose

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any liability that cannot be excluded under law.

Indemnity for Trade Users

If you are a Trade User, you agree to indemnify and hold us harmless from claims, losses, and expenses (including reasonable legal fees) arising out of:

• your listings, feeds, advertisements, or promotions
• your breach of these Terms
• your infringement of third party rights
• your unlawful conduct or misrepresentation

Termination

We may suspend or terminate your access if we reasonably believe you have breached these Terms or created risk for RoamWorthy or others.

You may stop using the Services at any time. Sections that should survive termination will survive, including ownership, scraping restrictions, disclaimers, limitations of liability, and indemnities.

Governing law

These Terms are governed by the laws of England and Wales, and the courts of England and Wales will have exclusive jurisdiction, except where consumer law requires otherwise.
